JDS Christmas Terms and Conditions 

These Terms and Conditions ("Terms") apply to the Christmas tree and wreath delivery, installation, and decorating services provided. By booking these services, you agree to the Terms, so please take a moment to review them before making a booking.

1. Service Description 

  • Delivery: We deliver Christmas trees, wreaths and other Christmas products to your specified location within our service area. 
  • Installation: If requested we will install the tree at your location according to your specifications. 
  • Dressing: For commercial clients we offer a tree decorating service, including the arrangement of lights, ornaments, and other decorations provided by either you or us (as per the chosen package). This service is unavailable to non-businesses.  

2. Booking and Payment 

  • Booking: To book our Services, you must complete the booking process through our website, by phone, or in person. Bookings are subject to availability. 
  • Payment: Full payment is required at the time of booking unless otherwise agreed. We accept card payments, apple pay, pay pal and klarna. Payment via BACS is only available to commercial clients. All prices are inclusive of taxes unless stated otherwise. 
  • Cancellations: Cancellations made more than 5 days before the scheduled delivery date are eligible for a full refund. Cancellations made less than 48 hours before the delivery date are subject to a 30% cancellation fee. 

3. Delivery and Installation 

  • Delivery Time: We will deliver our products on the date and time agreed upon during booking. Delivery times are estimates, and we cannot guarantee exact delivery times due to unforeseen circumstances.  
  • Access: You must ensure clear and safe access to the delivery and installation location. We are not responsible for delays or failures to deliver/install due to access issues. 
  • Installation: We will install the tree at the location specified by you. If additional equipment or labor is required for installation due to the nature of your location (e.g., high ceilings, unusual placement), additional charges may apply. 

4. Dressing Service 

  • Decorations: If you have chosen our dressing service, this will occur up to 48hrs after the installation has taken place. 
  • Design: Our team will dress the tree according to your instructions or, if preferred, based on our professional judgment. Changes to the design after completion may incur additional charges. 
  • Liability: We are not liable for any damage to decorations after the tree has been dressed. Please ensure they are suitable for the tree size and type. 

5. Customer Responsibilities 

  • Preparation: You are responsible for preparing the area where the tree will be installed, including moving furniture and clearing obstacles. 
  • Watering and Care: After installation, you are responsible for the care and maintenance of the tree, including watering. We are not responsible for the tree's condition after installation. 
  • Removal: If you have not booked our tree removal service, you are responsible for the disposal of the tree after the holiday season. 

6. Limitations of Liability 

  • Damage: We take great care during delivery, installation, and dressing. However, we are not liable for any damage to your property unless caused by our gross negligence. 
  • Condition: We guarantee the freshness and quality of our trees upon delivery. However, we are not responsible for any deterioration of the tree after delivery, as this depends on factors beyond our control, such as environment and care. Please note our trees are natural products therefore there may be some difference in shape. 
  • Other products: We guarantee our Christmas tree stands to be functioning as specified and to be in full working order. Should your stand arrive damaged or defective we will replace itfree of charge. However, we are not liable for any damage which occurs after use. 

7. Force Majeure 

  • We are not liable for any failure to perform our obligations under these Terms due to events beyond our control, including but not limited to severe weather conditions, labor strikes, or other unforeseen circumstances. 

8. Amendments 

  • We reserve the right to amend these Terms at any time. Any changes will be effective immediately upon posting on our website or otherwise communicated to you. 

9. Governing Law 

  • These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Scotland. 

By booking our Services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
